What is Medical Malpractice?

Medical malpractice is improper treatment by a doctor or health care professional that results in injury, damage, or harm. It does not require a plan or intent to do harm, it is simply an unacceptable medical error that hurts someone.

In Florida the improper treatment is called a breach of the “prevailing professional standard of care.”  This standard of care is defined by statute as “that level of care, skill, and treatment which, in light of all relevant surrounding circumstances, is recognized as acceptable and appropriate by reasonably prudent similar health care providers.”

Medical malpractice applies to all types of doctors and specialists, as well as to nurses, hospitals, technicians and other health care professionals.
